Patent Application in China Mainland

There are tree patent types in China, invention patent, utility model patent and design patent. For granted invention patents, the duration of protection is 20 years, counting from the application date, considering the annual fees are paid in time.

Chinese applications extended to Hong Kong and Macau

The patent application can only cover the mainland of China. If you want your patent to be protected in Hong Kong or in Macau, you may file the request to extend the patent to HK and Macau.

Rejection and Appeal

If a patent application is found to be unacceptable by CNIPA, and the applicant has been given at least one opportunity to make a response, a final rejection shall be made.

Invalidation

Anyone may request the Patent Reexamination Board to declare a patent invalid from the date of announcement of the grant of the patent right.

Maintenance and Management of Patent
