OPPO Corp. entrusted China Yomek IP to file an invalidation request for the trademark “欧珀OUPO” of No. 15921896. The Trademark Review and Adjudication Board supported Yomek’s arguments and the trademark was declared invalid.
The Trademark Review and Adjudication Board considered that the trademark and the cited trademark constitute as similar trademarks in the same or similar goods. At the same time, the holder of the trademark in this case has applied for registration of “欧锋”, “LMOTO”, “YMOTO”, “科沃斯” etc. which are similar to well-known trademarks. The aforementioned trademark registration act has the obvious intention of copying other well-known trademarks, which is obviously malicious, and does not have the legitimacy of a registered trademark. The improper conduct of such trademark registration will not only lead to the misunderstanding of the source of the relevant consumers, but also exceed the normal production and operation needs, which will disrupt the normal trademark registration management order, and undermine the market order of fair competition. Therefore, the trademark violates the provisions of the Trademark Law.
